TERMS OF SERVICE – DMVSTOP LLC

By engaging, accessing, interacting with, submitting documentation to, or otherwise utilizing any service, function, digital interface, communication channel, or transaction mechanism offered, provided, or facilitated by DMVSTOP LLC (“DMVSTOP,” “we,” “our,” or “us”), you (“you,” “your,” or “the client”) hereby knowingly, voluntarily, and irrevocably acknowledge, affirm, consent, stipulate, and agree that DMVSTOP operates exclusively and solely as a privately owned, third-party administrative processing facilitator with respect to various state motor vehicle–related procedures, and that DMVSTOP is not, does not represent itself to be, and shall not be misconstrued as any state Department of Motor Vehicles, any governmental or quasi-governmental entity, any state licensing authority, or any official public office. All fees paid to DMVSTOP constitute independent convenience, handling, administrative, or processing fees which are wholly separate from, and bear no legal equivalence to, any statutory state-imposed fees, taxes, penalties, assessments, surcharges, remittances, or mandatory governmental charges. You further agree that any quoted DMV fees or tax amounts are merely approximations provided for your convenience and may increase or decrease based upon subsequent state calculations, with DMVSTOP bearing no liability for such fluctuations. By proceeding with any transaction, you agree to pay the DMVSTOP service fee applicable to the selected service, as well as any and all registration fees, taxes calculated from the amount you paid for the vehicle, and any other state-imposed charges, which you understand may be greater or less than any estimate provided prior to submission due to the inherent variability of governmental fee structures.

You further certify, represent, warrant, affirm, and attest under penalty of law that all information, statements, data, certifications, attestations, signatures, and documentation submitted by you—whether transmitted electronically, physically delivered, or otherwise conveyed—are true, complete, accurate, authentic, unaltered, unmodified, uncompromised, legitimate, and lawfully obtained; that no individual other than yourself has completed, executed, or submitted the paperwork on your behalf; and that all documents, including but not limited to driver licenses, proof of identity, insurance cards, titles, manufacturer’s certificates, reassignments, odometer disclosures, lien documents, bills of sale, and any other relevant instruments, are free from any form of alteration, erasure, obliteration, overwriting, correction tape, white-out, strikeouts, substitutions, ink discoloration, nonstandard ink (including prohibited red ink in certain jurisdictions), partial or full removal of printed content, water damage, staining, tearing, adhesive residue, fading, smudging, illegibility, incomplete fields, or any physical or digital modification that may cause or reasonably be construed to cause a state motor vehicle agency to deem the document questionable, defective, fraudulent, or unsuitable for acceptance. You expressly acknowledge that any required title submitted to DMVSTOP must be presented exactly as issued by the state, with no attempt made by you or any third party to alter owner information, lienholder information, odometer readings, purchase price, reassignment sections, signatures, dates, or address information, and that any such alteration or perceived alteration of a title or related instrument is solely your responsibility, constitutes a document defect, may render the document legally void, may require procurement of a replacement, corrected, or duplicate title at your sole expense, and may cause delays, denials, or the necessity of entirely reinitiating a transaction at your sole cost. DMVSTOP assumes no duty to inspect, identify, detect, or warn you of alterations, defects, or inconsistencies; DMVSTOP submits documents exactly as provided and is not responsible for the consequences of any document-based rejection. Any false, fraudulent, altered, forged, or misrepresented documentation constitutes fraud and may result in immediate refusal of service, forfeiture of fees, reporting to appropriate authorities, and any civil or criminal penalties applicable under state or federal law.

You further acknowledge that DMVSTOP reserves the unilateral, unrestricted, and absolute right, exercisable at its sole discretion and without requirement of explanation, to decline, suspend, terminate, or refuse service to any client or transaction, whether before, during, or after document intake, including but not limited to circumstances involving suspected fraud, inconsistent or unverifiable documentation, mismatched ownership information, indicators of identity theft, missing or improperly completed documentation, abusive or hostile conduct, prior or active chargebacks, refusal to comply with verification requirements, or any designation of a client as “high risk” by DMVSTOP. DMVSTOP may implement additional verification requirements, including but not limited to secondary identification, notarized statements, proof of address, proof of funds, direct contact with dealers or prior owners, telephone or video verification, or any supplementary documentation deemed necessary in its sole discretion. You agree that refusal or inability to satisfy such requests constitutes grounds for immediate termination of service without refund, credit, or further obligation.

You acknowledge that all communications from DMVSTOP, including invoicing, requests for additional documentation, correction notices, rejection notifications, shipping confirmations, and completion notifications, shall be conducted primarily via email, and you accept full responsibility for maintaining a valid, accessible, and regularly monitored email address. DMVSTOP bears no liability for delayed, missed, filtered, or undelivered communications due to spam filtering, user inaccessibility, misentry of addresses, server failure, or any other client-related or third-party-related failure to receive or review communications.

You further acknowledge and agree that all processing times stated, implied, or estimated by DMVSTOP—whether orally, in writing, or through automated tools—are approximations only and cannot and do not constitute guarantees, warranties, or binding commitments. DMVSTOP has no authority to expedite, modify, interfere with, or influence state processing procedures, and you agree that delays may arise from DMV staffing shortages, postal or shipping delays, system outages, holidays, legislative changes, lost paperwork, title bureau backlogs, misrouting, incomplete submissions, agency review procedures, or other circumstances entirely outside the control of DMVSTOP. You specifically acknowledge that states employing centralized title bureaus—such as the New York State Department of Motor Vehicles Title Bureau—often require four (4) to twelve (12) weeks or longer to issue titles, and DMVSTOP bears no responsibility, financial or otherwise, for such timelines or for any consequences that may arise from them.

With respect to the shipment of license plates, registration documents, titles, or any other physical items, you acknowledge, understand, and agree that DMVSTOP utilizes third-party carriers such as Federal Express (“FedEx”) or other commercial shippers, and that custody, responsibility, and liability for such packages transfer to the carrier upon the carrier’s acceptance or scanning of the package. DMVSTOP does not warrant or guarantee the delivery, timeliness, condition, or actual receipt of any shipment and is not liable for delays, loss, theft, misdelivery, damage, destruction, or address-related issues attributable to client error, carrier error, or any other third-party action or omission. Shipments are not sent with signature requirements unless explicitly requested by you in writing, approved in writing by DMVSTOP, and implemented prior to shipment initiation. If an item is lost in transit, DMVSTOP reserves the exclusive right to determine whether the transaction may be reprocessed, whether additional service fees will be required, and whether resubmission is legally or procedurally possible; you understand that some transactions cannot legally be resubmitted and may require alternative channels outside the services provided by DMVSTOP.

Documents, materials, or items left unclaimed, unpaid, incomplete, unresolved, or otherwise abandoned at DMVSTOP’s office for ninety (90) days or more may, at DMVSTOP’s sole discretion, be returned to the billing or shipping address on file if service fees have been paid, or destroyed if fees remain unpaid. DMVSTOP bears no liability for the preservation, maintenance, storage, return, or condition of such documents beyond that period. Retrieval, reclamation, or reassembly of such materials may incur a minimum administrative charge of twenty-five dollars ($25.00), which you agree to pay as a condition of such retrieval.

Refunds, credits, cancellations, adjustments, or other financial accommodations—whether requested by you or evaluated by DMVSTOP—are not guaranteed, are not automatic, and are issued solely at the exclusive discretion of DMVSTOP. You acknowledge, understand, and agree that refunds shall not be issued for reasons including, but not limited to: missing, incomplete, invalid, altered, damaged, or expired documents; insurance lapses or invalid insurance; rejected paperwork resulting from information, documentation, or signatures supplied or omitted by you; altered titles or instruments rejected by a state agency; use of prohibited ink colors or corrections; cancellations initiated by you after shipping labels are generated or after documents have been submitted to any DMV or related agency; DMV or state-level rejection unrelated to DMVSTOP’s performance; delays attributable to DMVs, postal carriers, or other third parties; vehicle suspensions; toll violations; enforcement actions; or any transaction classified as high risk by DMVSTOP. If, in DMVSTOP’s sole discretion, a refund is granted, such refund shall be reduced by all applicable administrative and third-party costs, including but not limited to nonrefundable payment processor fees, shipping expenses, and a minimum fifty dollar ($50.00) deduction when DMVSTOP prepaid labels were used for inbound or outbound shipping. Refunds issued to credit or debit cards may require up to seven (7) business days to appear on your account, and refunds issued via other methods may require additional processing time.

If you initiate a chargeback, payment dispute, retrieval request, or reversal with a financial institution or payment processor related to any DMVSTOP service fee, DMV fee, or associated charge, you expressly acknowledge and agree that DMVSTOP will dispute such chargeback and may assess a separate chargeback administrative fee of fifty dollars ($50.00) per disputed item or transaction, which you authorize DMVSTOP to collect using any lawful means. You further agree that initiating a chargeback constitutes an immediate forfeiture of any right to a refund, credit, or further financial accommodation with respect to the transaction at issue, irrespective of the ultimate outcome of the chargeback process. If the chargeback is resolved in DMVSTOP’s favor, no refund of any kind shall be issued, and only a discretionary partial credit may be extended, if at all, solely at DMVSTOP’s option.

You expressly agree that DMVSTOP’s maximum aggregate liability to you, whether arising from contract, tort, negligence, statutory obligation, equity, or any theory of law or fact, shall not exceed, in the aggregate, the amount of the DMVSTOP service fee actually paid by you for the specific transaction giving rise to the claim, and shall in no event include or extend to any DMV/state fees, taxes, penalties, towing charges, impound fees, storage fees, postal or shipping costs, consequential damages, incidental damages, special damages, punitive damages, lost profits, lost business, lost opportunities, or any other indirect, derivative, or exemplary harm claimed by you or any third party.

By clicking “Submit,” “I Accept,” checking a box, or performing any act intended to indicate assent electronically, you provide a legally binding electronic signature, which you agree shall have the same force and effect as a handwritten signature and shall be admissible in any legal, arbitral, or administrative proceeding, without the need for certification authority, third-party validation, or further formality. You consent to the use of electronic records and signatures in all dealings with DMVSTOP.

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or related to these Terms, any transaction with DMVSTOP, or any services rendered or purportedly rendered by DMVSTOP shall be resolved exclusively and finally by binding arbitration administered by a recognized arbitral forum in Miami-Dade County, Florida. You knowingly and voluntarily waive any right to a trial by jury and any right to participate in any purported class, collective, or representative action against DMVSTOP.
